Hate speech and hate crimes are illegal under EU law, but only insofar as they are motivated by a specific set of traits, such race or ethnicity. The European Commission wants to expand the prohibition’s reach, and the European Parliament supports them. The Commission suggested in December 2021 adding hate speech and hate crimes to the list of offenses covered by Article 83(1) of the Treaty on the Functioning of the European Union (TFEU).
